1. Definitions

References to "us", "we", and/or "ours" in these booking terms and conditions shall mean Harvestman Enterprise Pty Ltd (ABN 46 079 615 768), trading as Variety Travel, a travel agent established in 1997.

References to "you", and/or "yours" in these booking terms and conditions shall mean any users of this Website and includes any person who we provide a Travel Product from a Third Party Travel Provider, or Booking and Advisory Services to.

“Website” means this website.

“Third Party Travel Provider” means the company or person who provides you with the Travel Product on terms and conditions agreed with you.

“Booking & Advisory Services” means services provided by us to you in assisting you to acquire a Travel Product from a Third Party Travel Provider and includes advisory and consulting services, making this Website and any software associated with it available to you, and providing a facility to enter into transactions with us and Third Party Travel

Providers (whose details and Travel Products appear on this Website).

“Travel Product” means the service or product provided by a Third Party Travel Provider, for example, an airline or a tour.

2. Agency

We act as an agent for Third Party Travel Provider only. We sell various Travel Products on behalf of numerous Third Party Travel Providers, such as airlines, tours operators and cruise line operators. Our obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and Third Party Travel Providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made on your behalf subject to the terms and conditions and limitations of liability imposed by these Third Party Travel Providers. Your legal recourse for travel services is against the specific Third Party Travel Provider and not us. If for any reason (excluding fault by us) any Third Party Travel Provider is unable to provide the services for which you have contracted your remedy lies against the Third Party Travel Provider and not with us.

3. Third Party Travel Provider

Third Party Travel Provider will provide you with the Travel Product on terms and conditions agreed between you and the Third Party Travel Provider after we book the Travel Product on behalf of you.

These terms and conditions are available from the Third Party Travel Provider and may include rules and restrictions about the use and availability of fares, products and services, refund and cancellation policies and the limitation or exclusion of liability for death, personal injury, delay and loss or damage to baggage.

You should obtain and read all of the Third Party Travel Provider's terms and conditions before acquiring Booking & Advisory Services from us.

4. Liability

To the extent permitted by law, we do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control and which is not preventable by reasonable diligence on our part. Under circumstances where liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the value of the purchased travel arrangements. Nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).

5. Price

All prices of Travel Products are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed until payment has been made in full and documents have been processed. All prices are provided as a guide only and may vary due to such factors include adverse currency fluctuations, changes in surcharges, fees or taxes or peak demand periods. You should contact us for up to date prices.

6. Refunds, Changes and Cancellation Fees

We will provide a refund to you after we receive the funds from the relevant Third Party Travel Providers. Refunds for Travel Product are subject to the terms and conditions that you agreed with the Third Party Travel Provider. Charges may occur if you cancel booking. These charges can be up to total cost of the booking, regardless of whether travel has commenced. Fees and extra charges may apply for changing booking and reissuing tickets or documents, for example, changing your name on your flight ticket.

7. Amendment and Cancellation Charges

Changes/amendments or cancellation fees and charges may apply to every booking. The fees and charges will be $50AUD per passenger per booking in addition to Third Party Travel Provider fees which are accordance with the terms and conditions agreed between you and the Third Party Travel Provider.

8. Booking Fees

$30AUD of booking fees per person applies to certain carriers and destinations.

9. Final Payment

Full payment is required at the time of booking.

10. Payments by Credit Card

Credit card surcharges may apply when paying by credit card.

11. Taxes

All taxes are subject to change without notice.

12. Schedule Changes

It is you responsibility to contact the Third Party Travel Provider prior to travel to ensure there is not any change to the scheduled departure time.

13. Passports & Visas

Valid passports, visas including transit visas and re-entry permits which required by immigration and other government authorities are your own responsibility. We accept no liability about any fines, penalties, payments or expenditures caused by such your documents not meeting the requirements of those authorities. You need to ensure that you have at least 6 months validity on your passport from your return date.

We can obtain such information from an external visa advisory service provider on your behalf but we do not warrant the accuracy of such information and accept no liability for any loss or damage which you may suffer in reliance on it. 14. Health

It is your responsibility to ensure that you are aware of any health requirements for your travel. Vaccinations are strongly recommended for certain destinations. Please contact your local doctor who will advise you of these requirements.

15. Travel Insurance

We are an authorised representative of Aussietravelcover Pty. Ltd. on whose behalf we act. For further information about Aussietravelcover Pty. Ltd, please link to their website: www.aussietravelcover.com.au. For details of the travel insurance products including a quote, please refer to the Website or come into our office to get a 20% discount. You must obtain and read a Product Disclosure Statement before you decide to acquire the product. Travel insurance is recommended by the Department of Foreign Affairs and Trade for overseas travel.

16. Travel Document

Third Party Travel Providers use travel document include (but not limited to) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) to confirm an arrangement. Travel documents may be subject to certain conditions, for example, being non-date-changeable or non-refundable. Travel document is only valid for you with your own name. An inability to use your booked Travel Product and cancellation of your booked Travel Product may occur if the name on your travel documents is incorrect. All airline tickets must be issued in the name of the passport or photo identity holder. It is your responsibility to ensure the names, dates and timings on your documents are correct.

17. Frequent Flyer & Special Requirements

You can insert your frequent flyer membership details or other applicable loyalty program details in the space provided for inclusion in your booking or contact us to provide your frequent flyer membership details or other applicable loyalty program details. You should check your frequent flyer program or other applicable loyalty program for the specific terms of your membership. We can not guarantee that the Third Party Travel Provider will credit you with points for your booking.

If you need any special requirements, you may have to contact us or the Third Party Travel Provider. We will pass on your special requirements to the Third Party Travel Provider but the special requirements can not be guaranteed.

18. Website & Links

We may modify the terms and conditions at any time without notice. Your acknowledge and agree that your continued use of the Booking & Advisory Service is subject to the terms and conditions in force at the time of your use.

We do not guarantee that this Website or any linked website will be free from viruses or that this Website or any linked website will be uninterrrupted.

19. Privacy Policy

We are committed to protecting your personal information under our Privacy Policy.

20. Monies Not Held On Trust

All monies paid by you to us will be our property and will pay to the Thrid Party Travel Provider after your booked Travel Product has been provided. You acknowledge and agree that such monies will not held on trust for and on your behalf and we may hold such monies in any of our account, including with our own and/or other customers monies.

21. Law

All matters arising out of or in connection with the agreement between you and us and all terms are governed by the laws applicable in the State of New South Wales. You consent and submit to the exclusive jurisdiction of the Courts of New South Wales in all matters arising out of or in connection with the agreement between you and us.
